AUCTION RULES / TERMS & CONDITIONS OF SALE

All online auctions will be conducted in accordance with the auction rules and terms and conditions of sale listed below and such other provisions as may be added by the auctioneer via e-mail or posted on https://auctions.beercansplus.com/rules.aspx

REGISTRATION

All users must register online and agree to the auction rules and terms and conditions of sale in order to bid. To register, click on the following link Register Here Please enter all required information, check the box to confirm you have read and accept these auction rules and terms and conditions of sale, and click “Submit” at the bottom of the page. You will receive an verification email confirming your application for registration. Please click the verification tab to complete your registration to be able to bid. If you registered for a previous Good Guys’ internet auction, please use your existing username and password to login.

During registration, you will create a username and password. Keep your username and password in a safe place for future reference, as they will remain your username and password for future Good Guys auctions. If you forget your username, password, or Bidder Id, you can click on “Forgot Bidder Id” and/or “Forgot Password” on the “My Account” page or contact us at (574) 532-1381 (phone) or info@theGoodGuys.auction (email).

You, as the User, covenant, warrant and represent that all information submitted by you is true, accurate and correct. You also represent and warrant that no other party or authorization is required for you to lawfully enter into this agreement. All registration and bidder information shall remain confidential. Good Guys Auctions reserves the right to approve or deny any registrant. If you are denied for any reason, we will notify you via email.

By registering, you are acknowledging that you have read and understand these Auction Rules and that you agree to all terms and conditions contained herein. Good Guys Auctions in its sole discretion may change or modify any of the terms and conditions contained in these Auction Rules, at any time. Any changes will be effective upon posting of the revisions on the auction website. Your continued use of the auction website following our posting of changes to these Auction Rules will constitute your acceptance of such changes.

Any breach or violation of the terms of this agreement may result in consequences including but not limited to, termination of the user’s account without notice.

In its sole discretion and for any reason, Good Guys retains the right to revoke an account and any bids placed by that account. In the event that an account and/or any bids are revoked, the account holder will be notified by phone and/or email.

BIDDING

You must be registered and logged in order to bid online. All bidders must be 18 years of age or older.

Pre-Bidding: You may preview items online and place an online bid at any time up to one (1) hour before live bidding begins. When bidding, you will be able to view the current high bid for each lot. You can enter a maximum bid amount, just like on eBay. If someone else bids, the system will automatically increase your bid up to your maximum bid amount, with the intention of winning the item at the lowest possible price. If someone outbids you, we will notify you so you can decide if you want to increase your maximum bid.

Telephone bids from registered bidders will be accepted between 8:00 a.m. and 5:00 p.m. (CST), Monday through Friday, at (574) 532-1381, up to one (1) hour before live bidding begins. Remember that bidding is a contractual obligation. When placing a maximum bid, be sure you're prepared to pay that amount if you win the auction.

Bid Increments: The amount the bid increases when someone bids is the bid increment. The following bid increments will apply to all auctions.

Reserve Amounts: In addition to minimum opening bids, the Owner/Consignor may set a reserve that represents the minimum price they will accept for the lot. If your bid doesn’t satisfy the Seller’s reserve, we will notify you so you can decide if you want to increase your maximum bid. All items that meet reserve will be sold to the highest bidder.

Live Bidding: Live bidding will start with Lot #1 and continue in numerical order until the completion of all lots up for auction that day. To participate in live bidding, please log in to your account and click on the “Live Auction” button. The lot’s “Details” page will show bids as they come in and the current highest bid for the lot. You may enter a higher bid by clicking the appropriate button. In the event two bids of the same amount are placed on an item, the first bid will be honored. You will be notified if you are the high bidder and if you won the lot.

During live bidding, Good Guys will attempt to provide registered bidders access to bidding by phone, but cannot guarantee such access. Please call us at (574) 532-1381 or submit a written request via email to info@theGoodGuys.auction no less than 48 hours before live bidding begins to request a call during the auction.

A bid cannot be cancelled or retracted once you place it. In the event of a disagreement regarding bids, Good Guys’s determination shall be final. Good Guys reserves the right to accept, reject or limit the amounts of any or all bids by any bidder for any reason and in its sole discretion.

Consignor bidding and shill bidding are strictly prohibited. Bid manipulation of any kind is expressly forbidden. A consignor may not place bids or arrange to have bids placed on his or her behalf. Shill bidding is any bid(s) placed by a person or persons to drive up the final price and without intent to take ownership of the lot. It is against the law to make bids in a false name or with an invalid payment method, even if Good Guys’s software initially accepts a bid. The bidder agrees to not use any device, software or routine to interfere or attempt to interfere with the proper working of any transaction being conducted on and during any auction sale.

Buyer’s Premium: A buyer’s premium will be added to all successful bids and is part of the total purchase cost. The buyer’s premium is 15% of the winning bid price, which will be discounted to 12% if payment in full is made by check or money order within 7 days following the end of the auction. Third party platforms may assess additional fees. Please refer to your selected platform which will indicate the buyer’s premium for that particular platform and auction.

INVOICING, TAXES & FEES

Invoices will be emailed to all winning bidders. Invoices are also available online within 24 hours following the close of the auction. Winning bidders who do not have access to internet or email may request a paper invoice be mailed to them by calling (574) 532-1381 or emailing info@theGoodGuys.auction the Monday after auction close or notifying Good Guys in advance. Invoices are due and payable within 14 days after the close of the auction. However, you must pay via check or money order within seven (7) days after the close of the auction to receive the 3% discount on the buyer’s premium.

Sales tax will apply to items that are picked up at our Indiana office or shipped to winning bidders within the State of Indiana. Certain countries, regions, states, counties and municipalities may charge taxes or fees to buyers living in their jurisdictions. Please familiarize yourself with these and how they will affect your purchase prior to bidding

PAYMENT

Payment must be received within 14 days after the close of the auction. Payment may be in the form of personal check, certified/cashier’s check, money order, no-fee wire transfer or Paypal. MasterCard, Visa, Discover and American Express credit cards are accepted. Please include your username and lot number(s) purchased as the “additional information” that you may provide when paying via no-fee wire transfer.

To receive the 3% discount on the buyer’s premium, you must pay via check or money order within seven (7) days after the close of the auction. Payment may be mailed to Good Guys Auctions, P.O Box 6, Granger, IN 46530.

If a winning bidder does not pay an invoice in full within 14 days following closing date of the auction, Good Guys retains the right to cancel the sale and return the item(s) to the consignor(s), sell the given item(s) to an under-bidder, re-offer the item(s) at subsequent auction(s) or for private sale, dispose of the item(s) by other means, or hold the non-paying winning bidder liable for the purchase price plus any and all losses incurred. The non-paying winning bidder agrees to pay any and all costs of collection, including legal fees and court costs incurred by Good Guys in collection of these losses. A 1.5% monthly interest rate will incur on all unpaid invoices after 30 days.

TITLE, RISK OF LOSS & REMOVAL

Upon the close of bidding for the item, title to the offered lot will pass to the highest bidder who thereupon assumes full risk and responsibility for any loss or damage to the property. Removal is at the sole expense and risk of the Buyer.

Following payment, the Buyer is solely responsible for and assumes all risk for packing, insuring, and transporting the item(s) purchased. Upon request, Good Guys may as a courtesy assist the Buyer in packing or transporting items; however, any loss or damage occurring during packing and/or transit shall remain the Buyer’s sole responsibility.

The Buyer is responsible for and will be invoiced for all shipping, handling and insurance costs. Payment for your invoice must clear in full prior to shipping. All packages will be shipped with $50.00 Postal insurance Coverage in the order that payments are received. The Buyer May Request Additional Insurance Coverage at the Buyer's sole cost and Expense. Please allow up to four (4) business days following clearance of payment for items to ship. Extremely large or heavy items may require special shipping arrangements. Packages will be shipped to the shipping address identified in your account. Non-US buyers are responsible for paying any customs and/or duties that apply.

AS IS

All property is sold AS IS – WHERE IS – HOW IS and WITH ALL FAULTS, known, apparent or otherwise. All item descriptions, dimensions and estimates are provided for guidance only. No descriptions or statements, either oral or in writing, by Good Guys or the Owner/Consignor(s) concerning any item or lot shall be construed as a covenant, representation, assumption of liability or warranty of any nature, either express or implied. Bidders are strongly encouraged to carefully inspect and satisfy themselves as to item/lot’s nature, quality, condition, age, size, rarity, historical relevance, provenance and value. All Bidders rely solely on their personal inspection in this regard and not on information listed in the item/lot description, on the invoice or otherwise provided by Good Guys or the Owner/Consignor.

The IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND ALL OTHER WARRANTIES, EITHER EXPRESSED OR IMPLIED, ARE SPECIFICALLY EXCLUDED and shall NOT apply to the merchandise that is the subject of these sales. All items are sold for display purposes only.

ADDITIONAL TERMS

Good Guys retains the right to postpone or delay the auction for any reason, including for reasons beyond its control, without recourse. Good Guys further retains the right to withdraw any item in the auction at any time for any reason whatsoever and shall have no liability for such withdrawal.

Good Guys may occasionally experience Internet or service outages during which bidders cannot participate or place bids. If such outages occur, Good Guys may at its discretion extend bidding for the auction, and/or allow a bid to be placed by a bidder who was unable to bid by deadline. Good Guys is not responsible for system errors and/or software problems if they occur during an auction, or the failure of the auction program to execute any bids on behalf of the bidder. NO RETURNS

All sales are final. There are no returns.

LIMITATION OF LIABILITY

In no event shall Good Guys or the Owner/Consignor be liable for any damages of any type or nature (whether in contract, tort or otherwise), sustained or claimed by any bidder, person or entity arising out of or in connection with this agreement. Without limiting the foregoing, in no event will the liability of Good Guys to any bidder for any act or omission occurring in connection with the auction exceed the amount that such bidder, person or entity has actually paid to Good Guys as a deposit or as payment for a purchased item. Good Guys and Owner/Consignor shall have no liability for any claims made by any bidder who is not the winning bidder of a particular lot or lots.

GENERAL RELEASE

Good Guys is not a seller, buyer, or bailee of any goods posted for sale on the Good Guys site and all sale transactions are strictly between buyers, sellers or other participants. In the event a dispute arises between one or more participants each party releases, and agrees to indemnify and hold Good Guys and its affiliates (and their respective agents, employees, officers, directors and shareholders) harmless from and against any and all claims, demands causes of action or damages of any kind, known or unknown, suspected or unsuspected, disclosed or undisclosed, and whether arising in tort or contract, in connection with such dispute.

DISCLAIMER

GOOD GUYS MAKES NO GUARANTIES, WARRANTIES OR REPRESENTATIONS, EXPRESS OR IMPLIED, THAT THE SERVICE PROVIDED BY THE SITE WILL MEET YOUR REQUIREMENTS, OR THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE, NOR DOES GOOD GUYS MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SITE OR AS TO THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE SITE OR THAT DEFECTS IN THE SOFTWARE WILL BE CORRECTED.

ANNOUNCEMENTS

Any announcements by Good Guys made on the day of the auction or during the course of the auction shall supersede and take precedence over these terms and any previously distributed terms, information or advertising.

APPLICABLE LAW

These Auction Rules and terms and conditions of sale, and any disputes arising out of or related thereto, shall be governed, construed and enforced in accordance with the laws of the State of Indiana applicable to contracts entered into and to be performed within the State of Indiana. Bidder agrees to submit to the federal or state courts of Auctioneer’s choosing located in Indiana for the exclusive jurisdiction of any disputes.

NO WAIVER

If any provision of these Auction Rules and terms and conditions of sale is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. Good Guys failure with respect to a breach by bidder by you or others does not waive the right to act with respect to subsequent or similar breaches.
